i was typing in 4 letter domains on a whois and typed gmby.com. The nameservers were set to mydomain.com, so i went to mydomain.com and tryed adding it to my list. Amazingly, IT WORKED!! The guy who registered it never put it on his mydomain list. Is that illegal?

This problem occured to me before... I was thinking that if somebody knew that my domain's DNS were MyDomain's, they can control the domain at their will with MyDomain. Of course, if the domain owner was to change the DNS, then... good for him!
