Just wondering if you should base your legal information based with the country in which your server is located or where your located.

I believe the part of your legals where you are restricting people from uploading certain files should be based around where the server is located.

You need to make one based on aussie rules but also strictly take into account, the terms of your provider in US AND the US laws.

Your lawyer (if you hire one) will know what to do. :)

I live in India and my DC (server) is in the US. So I have both Indian and US laws on my TOS/AUP.

Always the best solution when it comes to the legal stuff, though the contract should always be where the business is located, e.g if you're in Canada - follow Canadian laws and set it to those standards.
