Ok well here's a good one for you! A relative of mine owns a realter and she has a website, or did for that matter. Her "friend" who ran it and bought it for her decided after an argument they had to suspend her account and not give her access to the domain name. Now the domain is in the woman's name and email but the contact email is with the domain (@thedomain.com). It is a registered business and she thinks at this time the only thing she can do is change her company name to something else, which everybody knows is a pain to do and costs more, especially since it is a registered business in the USA.

Is it possible for me to get the domain name back for her? And if so.. how?

If the domain is in the friends name that setup the account for her there will be limited things that she can do. She can try to contact the registrar and advise them of whats going on and provide her registered business information and they may be able to help her out..this is a sticky situation to be in :(

The name on the domain is all her contact information, she just doesn't have access to the account.

Ahh ok thats a easy fix, contact the domain registrar and they will be able to reset the password for her once she verifies her information, hope this helps :)

Ok well now I am playing "legal entity" for her and have gotten into contact with her "friend" who has ownership of the domain. Made it rather professional so lets see if she goes for it.

OK here is the current situation.

The domain name that she owns she has no access to it via namecheap, and the email on file to get it back is with a domain she no longer has control over with godaddy, the owner is "james francis" which I have called and left a message(she has no bloody idea who this guy is by the way). I have also sent an email to namecheap hoping to god they will be co-operative.

the person who originally registered the domain denies the fact and she is still very unfriendly with my grandmother about the matter. She has been rude even to me, and has bluntly lied about issues such as a $5,000 dollar loan she appearently has, which my grandmother doesn't even have and has stated as such.

nickn at WHT (http://www.webhostingtalk.com/member.php?u=35857) runs the hosting side of NameCheap - he can likely put you in touch with someone on the domain side of the business who can help you out.

I managed to open a ticket with NameCheap and they emailed her, and she faxed in some documents proving she was who she was, and she gained access to the account =)

She is older though and forgot she had actually registered it herself. :P
