DALLAS (AP) — A Boston inventor has accused tissue giant Kimberly-Clark Corp. of swiping his brainchild — moistened toilet paper on a roll — and trying to clean up a potentially huge market.
John J. Marino says he's not taking the challenge sitting down. Instead, he's talking to his lawyers about a possible trademark-infringement case.
Kimberly-Clark, the maker of Kleenex, Huggies, Kotex and other paper and consumer goods, said Friday its product and Marino's are clearly different.
The spat hit the fan earlier this week when Irving-based Kimberly-Clark announced it would begin selling Cottonelle Fresh Rollwipes, a moistened toilet paper that unspools from a plastic dispenser like baby wipes on a roll.
``I first thought of that in 1993,'' Marino said Friday. ``I was changing my daughter's diaper with a baby wipe and I thought, 'Wow, this cleans a lot better than dry toilet paper. Why isn't there a moist toilet paper for everybody?' ''
Marino, an engineer, former Massachusetts state government official and entrepreneur, found investors who put up $6 million to produce MoistMates. The product hit grocery shelves in the Northeast in 1996, with a plastic dispenser that attached to the toilet-paper holder found in most bathrooms.
But the company, NuWay, ran into financial trouble and stopped production. With a patented reconfigured dispenser and different suppliers, a new company called Moist Mates LLC resumed production about four months ago, Marino said.
Sales have totaled less than $100,000, he said.
Marino said he approached Kimberly-Clark more than three years ago to see if the bathroom giant wanted to buy MoistMates.
``I actually recall one conversation I had with Tom Falk,'' Kimberly-Clark's president and chief operating officer, Marino said. ``He said, 'No, we don't have any interest in that area.'''
Falk did not respond to a request for comment. A spokeswoman initially said Falk did not remember talking with Marino, but later confirmed the conversation occurred and that Kimberly-Clark had been asked about buying Marino's company.
``We looked at it, but we had no interest because we had our own product under development,'' Tina Barry said.
Barry said Kimberly-Clark researched all the patents for wet wipes and dispensers, and company officials believe there are key differences between its product and MoistMates. For example, she said, Fresh Rollwipes will disperse, or break down into fibers, after flushing.
``MoistMates are flushable but not dispersible,'' she said. Marino responded that his product is biodegradable and meets standards for avoiding sewer and septic backups.
One thing both sides agree on: The potential market for rolled wet wipes is huge. Kimberly-Clark estimates sales could hit $500 million within six years.
``I think we have a big winner on our hands,'' Barry said.

I'll take my TP dry thank you, not that anyone needs to know my preference for wet/dry TP. Although I must admit I've not experienced wet, I'm just thinking wet=cold and cold=not what I want in that region.

For anyone who hasn't 'gone wet' yet... please moisten some TP and try it. It feels cleaner, and fresher. I recommend it.
