Leriss October 15th, 2005, 11:13 Hi,im worry that maybe some of my customers are going to put warez stuff. And the Question is: "How to not be sued if that will happen?"
Maybe Place in T.O.S "We are NOT responsible for the Content of your Web Site and are NOT Legaly Responsible for any illegal Activites!." <-- will this save me from legal and sue problems?
Robert October 15th, 2005, 12:20 No. YOU ARE responsible for the content on your own server.
uzzer October 15th, 2005, 12:22 well, you are going to have to make regular check on ALL your customers to make sure. If you do find warez related sites in your servers, then you delete them.

Hmm...you are giving away that legal advice for FREE?
Anyways, in response to the original question: You MAY be held liable for any sort of illegal activity done by users using your services.

rapidupload October 16th, 2005, 19:08 You may be held liable, you need a lawyer to go over your TOS. It is best to incorporate to limit your liabilities as well.
Blank Verse October 16th, 2005, 20:15 Have you ever considered monitoring what goes on your site to help ensure this doesn't happen in the first place? Maybe disabling the upload of certain filetypes that are generally associated with warez? If it were me, I'd be taking the precautions needed to avoid any sort of legal controversy in the first place.
Wojtek October 16th, 2005, 22:30 Siema Polska!
