PHILADELPHIA, Pennsylvania (Reuters) -- The popular breakfast pastry Pop-Tarts has become a burning legal issue in New Jersey.

The Philadelphia Inquirer reported Saturday that a New Jersey couple is suing the Kellogg Co. for $100,000 in damages caused to their home when an unattended Pop-Tart allegedly burst into flames inside their toaster.

Brenda Hurff of Washington Township put a cherry Pop-Tart in the toaster and left the house to drive her children to preschool, the newspaper said. When she returned 10 to 20 minutes later, smoke was pouring from the home and firefighters were already on the scene.

"I never thought a Pop-Tart could turn into a blowtorch," Hurff's attorney, Mauro Casci, told the newspaper. "Did it pop? Did it not pop? Who knows?"

The local fire company listed the cause of the blaze as "unattended food."

A Kellogg spokesman declined to comment on the lawsuit but told the Inquirer that the cereal maker's products were safe and do not cause fires.

Pop-Tarts, which are filled with fruit preserves, carry a warning on the box advising customers not to leave the toaster unattended due to a possible risk of fire.

The lawsuit, filed this week in Gloucester County Superior Court by Hurff and her husband, also named toaster-maker Black & Decker Corp. as a defendant. The newspaper said the appliance maker had no comment on the suit.

In 1995, Kellogg paid $2,400 to a Springfield, Ohio, man who said that a fire started from a Pop-Tart had damaged his home, the Inquirer said.

The man's lawyer had considered calling as a witness humorist Dave Barry, who had written two years earlier that he caused a pair of strawberry Pop-Tarts to ignite by putting them into a toaster and holding the lever down for six minutes, the newspaper said.

So even if it is your fault you can sue the company? What if slip on soda you dropped on the floor... now you can sue the company that makes it.... pathetic! People can sue just for about everything today, even if it is their own fault.

actually it happened a few years back. she spilled coffee on her lap in her car and sued because she said it was too hot and she received 2nd and 3rd degree burns. is that dumbass or what?

if you take any fresh cup of store-bought coffee and spill it on yourself, you'll get the same effect.

People can, and will sue for anything and everything. You know, if you have an indoor pool, and someone climbs your fence, breaks into your house, and drowns in your pool, you're liable? Can you imagine? The "victim's" family can sue you. Maybe not win, but if they'll award someone for spilling coffee on themselves, I wouldn't doubt it. ;)

Remember this one: A robber was breaking into a house, he seriously cut himself on a knife that the owner's of the house left around. He sues and wins. I don't remember if he was charged for breaking in the house, but gained money even if he didn't take anything from the house.

Our legal system is in trouble.

It is well known among pranksters that pop-tarts are highly flammable. especially strawberry. If you do it right you can get 5-10 foot flames, and a melted toaster.

u australians might know this but recently a muslem brought a vegetarian pizza and ate a piece of mushroom all something and blame pizza hut saying it was bacon :D he then demanded $10,000 +more for other cost to go to india for a spiritual cleansing :D :D pizza hut said they would give him a life time supply of free pizzas (i would of took that;) ) lol idiots :D :D maybe I should sue u guys for calling me weeps:D :D no seriously:mad: :mad:

lol recently around here a 36 year old lady had a pool, the neighbours kids climbed over for a swim drowned and die (shame):D and then the neighbours sued here for 6 millions for their childs life and won:confused: lol that kid deseved it man lol, imagine 6 million dollars.......maybe a fake death would do?...........

hmm............

I'm sure I can sue peo for something. This board must have damaged me in some way..... lost earnings. I could have bought a winning lottery ticket and my addiction to this board stopped me getting out to the shop......

I saw no warning when I came here....

subsequently to not winning millions on the lottery I have become depressed and resorted to using vast amounts of crack cocaine as the only way to cope with the stress....

now penniless and forced into a life of prostitution and petty crime......


that's worth $1,000,000,000 at least, people have got twice that just for having a couple of drags off a cigarette.

Oh you guys have forgotten the best one!

Lady a few months ago sued McDonalds because the pickle fell onto her lip and it burned her lip.

What was a reason for suing?

"She could not perform oral sexual acts on her husband for a few weeks as a result of the incident"

I read some articles about how Prison inmates can sue and win.

I think I read that some inmate complained the food wasn't adequate and it went to court and the Judge ruled in his favor.

Now I thought going to Prison and serving hard time you lost some of your rights.

Anyone can sue... even if you are locked up in prison if you feel you've been mistreated or your rights have been violated you can sue and win.
