More than likely they are not, and this will be more hassle than its worth to be honest.

Well... "TORRENTS" themselves are legal. Torrent Trackers are legal as well. It's all how you use it. Also you can't really prevent people from uploading illegal files, but you can ban them after doing so. I think it should be fine, just make a TOS with a client whoever you allow to host torrent trackers on your server tell them if the RIAA or whoever contacts you remove the content immediately, shut down the site or it'll be shutdown for them :). Easy way of making both you and the RIAA happy.
