    Question Non-US vs. US Hosting

    Could somebody explain to me the differences in having your sites located in US vs. Non-US as far as legal liabilities. What additional protections would I have with Non-US? I know that The Netherlands/Germany are more lenient with adult site material. The main site in question isn't adult related. It is more on the line of pharmaceutical suppliers. The actual site doesn't sell pharmaceuticals, but it points to places where you can obtain them, as well as discussions about different meds. What about Canada vs. US? Any help would be greatly appreciated.

    it all depends on where you live.

    If you are too far from the server it will mostly be slower.
    So if you live the States your better with hosting from the States.

    Well canadian servers usually don't take sites that sell pharmaceuticals products unless they are registered and have the right to re-distribute them.
    I'm not sure about the states though.

    You don't really want to be taking legal advise from a public web forum

    If you're concerned, talk to your lawyer, they're the ones who'll have to bail you out if you get it wrong.

    If you live in the US and are buying hosting buy from either a host located in the US if you are scared of liabilities.

    Generally a big price difference in most regions
    Australia for example is very expensive.

    USA is probably the best place for cheap data since theres so much Competition there.

    As far as legal liabilitys are concerned i think you are totally safe hosting in the netherlands (but then again it depends on what facility/upstream you use) - If you are representing an american company on a server outside of america i think you would still be liable (if that makes any sense.)

    I hope your not one of those ------ emailers

    he he he i was not bashing you. Its just the first thing i thought of since i get sooo many MEDS emails.
    About 95% of my emails is spam. everything from meds,mortages,virus's and a few that are in other languages (still trying to work out what there selling.)
    Some are so bad there spam links dont even work. At one stage i was recieving 1500 spam/Day and could only retrieve my email at work using Shell/Pine in linux.

    Anyway, back onto the topic ;-))

    So what are your legal concerns exactly.

    What are you doing that you think could cause you problems?

    Basically it is what I oringally stated in the first post. A site that charges a membership fee and gives members access to legitimate online med suppliers. Some located in the US, others overseas. The members can also discuss their experiences with these people, etc. So I don't think that I'm really doing anything wrong, however the example was once given to me that it was sort of like charging a crack head a fee in order for me to tell him where to buy crack.

    Now that I think about it, what I'm doing isn't really any different than any of these affiliate banners that people make money off of by directing traffic to online med stores. However, I do absolutely no spamming, emailing or any advertising other than being listed in search engines.
