Spammer wants his money back

I think that in this case when spammer ask for the refund. You need to have all proves in pocket and forget him and teke things easy ;)
 
Paypal sided with us and no refund was given.

You're one in a million then, PayPal almost always sides with the buyer as the seller isn't as easy to loose as a customer. Last time this happened to me, PayPal just refunded their money without even letting me put in my say or the evidence that it was, in fact, a legit order, and was suspended because of a violation of our TOS.

Same thing happened with me.

I can almost guarantee that the order was paid with via Credit Card. You can NEVER win against the Credit Card company.... With paypal balance, its easier to win if you are the seller, but if they are smart and pay with CC, then do a chargeback at the CC level, then they are sure to win.
 
Paypal will always side with you, it's virtual goods they don't refund for that.

Second, I didn't take the time to read your TOS, but based on the fact that you got worried and posted here, I'd say it's not enough. You need a clear and definitive spam clause that outlines the action you'll take.

yes, paypal would side with you for Virtual good IF they had requested a charge back due to something like inadequate service, but they stated that the card was used without their consent, which is completely different and paypal 99.9% of the time will side with the client, whether they're lying or not.

Just looked back in my history, and indeed you are correct, it was a CC payment... :tired2:
 
This is very interesting to hear but again no hurt in refunding

And you are still running a company? Thing is, he broke the TOS, and it's completely the customer's fault. You don't refund someone when they broke an agreement.
