gkg.net : impossible to quit ???

Hello,

I own many names at gkg.net, and I have discovered in their policy that, if you want your names be transfered to another registrar, you have to pay $200 per name ! And the new owner has to accept the same conditions !

I am french, not english nor american, perhaps have I misread their REGISTRATION AGREEMENT ?

If not, is it legal ?

I don't have any domains with GKG.net, so I'm not familiar with any of their terms of service, but yes, I do believe GKG can charge whatever they want for any service. As long as it was in the TOS when you signed up, it's legal.
 
If you are the owener listed on the domain, you can transfer it to an other registrar without gkg.net can charge you for it!
 
I think you misread:
In the event of a charge back by a credit card company (or similar action by another payment provider allowed by us) in connection with the payments of the registration fee for your domain name registration, you agree and acknowledge that the domain name registration shall be transferred to GKG as the paying entity for that registration to the registry and that we reserve all rights regarding such domain name including, without limitation, the right to make the domain name available to other parties for purchase. We will reinstate your domain name registration solely at our discretion, and subject to our receipt of the initial registration or renewal fee and our then-current reinstatement fee, currently set at US$200.
If you cancel the pay, and then want the domain, you'll have to pay 200$. I think this is correct, but it's kinda complicated.
 
If that is what you were reading truedomain, then it isn't complaicated at all and gyrbo is correct.

But I've read another paragraph, lower in the registration agreement :

[You agree that prior to the effectiveness of any transfer of ownership of your domain name to another entity, you will pay GKG the then-current fee set forth by GKG for the transfer of ownership of a domain name.]

What do you think of that ?

This is referring to transfer of ownership of the domain, meaning you own it and want to give it to me. I'm not sure of the change of ownership fee, if any.
 
The thing is to know if the fee is $200 as above or the registration fee of $10?
$10 is undestandable, $200 is abnormal.

I'm still going by your original question, though in re-reading it, it seems to indicate that you might be talking about two different things at the same time. Maybe you are confusing the terms a bit? Registrar is the place at which the domain is registered (ie: gkg or networksolutions, etc.). Registrant is the person or entity that registered the domain (ie: you).

One is transfering a domain from gkg to another registrar. This should be free (on gkg's side), and will only cost you the one year fee of registering a domain at the new registrar (the one year fee will also add a year to your current registration term so you really aren't being charged a fee exactly).

The second is transferring a domain from one registrant to another. This would happen if you sold the domain, etc. The fees for this are not stated in the excerpts of the TOS you quoted, and I am not familiar with gkg's fees for this (though there might not even be any).

The $200 you mentioned is only would only be impossed after the following scenario:

You register a domain with a credit card. You them call the bank that issued the credit card and state that you did not make that purchase and you want the charge removed from your bill (this is commonly known as a chargeback).

Now, since you refused the charge, and it was taken off your bill, you haven't paid gkg for the domain. In this case, ownership of the domain reverts to gkg (not you), and if you want to get the domain back (retain ownsership), you'd have to pay them $200 to shift ownership back into your name. This isn't something you need to worry about unless you are trying to scam gkg by refusing to accept the charge that you made.

If you can't find information on gkg's sitre re: ownership changes and possible fees, you should shoot an email to gkg asking:

"I cannot find information about possible fees associated with transferring a domain that I own, from one registrant to another registrant, and I was wondering if there are special procedures I need to follow?"

I finally received the answer to my doubts :

"If you transfer the domain to a new registrant, you may do so online- there
is no charge for this. If you ask us to make the change there will be a
$15 fee.

If you want to transfer to a different registrar, we do not charge a fee
but you will have to pay the gaining registrar.
