No, they couldn't - that sort of thing is allowed in films/tv etc, it would be stupid if every time somebody said something like "photoshop" they say under their breath "photoshop is a registered trademark of adobe incorporated".

If a trademark is overrused, the holder loses the trademark. I think that's what happened with zipper.
