There is not real penalties for placing that in your company name but you need to say at the bottom that your not a INC the only real way to get in troble for it is if the name is already incorperated you can get corp docs from most companies by requesting them there are also place to search online for corp names but quite a few companies out there are owned by a single person and say they are INC.s, because alot of people cant afford it.
INC are done by state me myself payed $1450 for my laywer to incorp me in California but I also formed a LLC which cost me $1100 but the fee depends on your state and who is forming the INC for you.

Im in California, i payed my lawyer to do it, it was a 2 day thing, most of it was a 2 day filling fee that i do believe was $400 but my lawyer is one of the best business lawyers in my area and he is the owner of the law firm so i pay extra to deal with also but the extra it cost me is well worth it it protects me and my partners for lawsuits.
