On sep 2 I got email from hivelocity stating that SPAM Mail were sent out from our server & therefore it has been terminated. The email is as below, we were doing vps hosting on that server & the IP they have stated is one of our clients vps. He sent spam mails & Hivelocity just terminated our server without any warning & emailed us after terminating the server.

NO warning to fix the issue. When we are doing hosting business anyone can purchase the account & abuse our server but they should have given us a warning to fix the issue & we never had any spam mail issue in past. This was the first one & they terminated our server. We have used burstnet, softlayer & some other data center in past & everyone warn first & only terminate the server when the issue is not fixed.

I called them & ask to put the server back for 24 hrs to allow to copy clients data to a new server but they are not agree.

I did chat with Steve their general manager & here is what he says

He kept me waiting for half an hour approx then he says he'll update me in ticket. He even don't know exactly about the issue. First he said all of ,y server IPs are got blacklisted then he says we checked some randomly & all of them are blacklisted. I asked him to show the other IP except 66.232.97.148 & he has no answer.

Here are the IP address associated with my server, please check them & let me know anymore is blacklisted except 66.232.97.148

There was no abuse till I paid them just before 5 days. After I paid them for this month the abuse issue was borned & they terminated my server. I asked them for refund for the service they are not going to provide me but they are not ready to refund.

The worst thing is they do not care for their clients, I requested them just to open the server for 24 hrs to copy clients data to new server but they are ridiculous & don't understand anything.

Please beware of these guys. I have got WORST Service & support in industry from them.

They told me that they are putting the server back online for 24 hrs so I can move data to new server but then they said the HDD is throwing errors & they are trying to recover the data & till now I have not get the data back.

Just wanted to all of you aware of this.

If anyone has server with Hivelocity please NOTE: if someone sends a spam email from your server they will suspend you with out any notice, without any chance to fix the issue & will get you out of the business.

Well I do not fully feel sorry for you, well its poor that there was no suspension so that you could fix it, I believe in high abuse issues you should be shut down till you respond to the company... Though notice should be sent out.

The reason I say I don't feel sorry is if your going to host customers, its your responsibility to monitor them. And with a VPS or Dedicated server you have no reasons not to be checking on your customers, if your unable to monitor them then really you shouldn't be in the industry.

Its harsh, but your responsible to your customers just like Hivelocity is to theres, and you having a spammer on your service effects more then just you.

Sorry again to hear but let this be a learning experience. Time to hire a proper team to monitor your network and services.
 
whatever you might be thinking. I just thought to aware all of you. Terminating a server without any notice is not a good business either.
 
Been through this on WHT with you already. Maybe if people read that thread, they'd feel more sorry for HiVelocity that you!?
 
This customer maliciously spammed off our network for 2 months. The spam derived from many ips, not just one as he might have you believe. This was a self-managed server and it would have been very clear to the customer that it was spamming if he was doing his job. He got every ip on his range blacklisted. We do provide warnings to accidental victims who have a rogue customer spamming. This abuse case was clearly malicious and ongoing with no concern for our network.
 
This ex-customer is on a smear campaign after we shut his server down for blatant spam abuse. His server was found to have sent spam for over a month off of multiple ips. He got every ip in his range blacklisted. This was a self-managed server so it was up to him to ensure his server was abiding by our policies. The abuse was over an extended period of time and had he been maintaining the server the spam would have been obvious for him to identify. OP is either a spammer or simply did not manage his server as was his responsibility.

"This customer maliciously spammed off our network for 2 months." You should have warn him before termination. For 2 month you let him spam un-noticed? 24 hour notice should be fine.

I'm not siding either on his side (as spamming is immoral things to do) on your side but at least a proper take down notice would solved the problem rather than termination without notice.
 
I would have done the same thing. In fact i find it hard to belive they let his server spam for two months.

I would have killed his server the first time a IP became black. You ask any spammer that gets caught on my server,Killed without a trace.

Same here. In fact I am about to open another support ticket with my datacenter because I see one of their other units persistently attempting to gain access to my sshd and ftpd. Hopefully it is just their own staff checking up on things, I might have to create an account for them if that is the case, but if not then one of their other customers has something going on that needs to be corrected.

And yeah, it says very clearly in my terms of service, likely a lot of datacenters and hosts have something similar to this as well:

All accounts found to violate these terms will be terminated without notice or refund

Though in practice actually doing this could result in a smear campaign, so it is better to give some notice first and just remove the offending content for first offenders.

I would never ever recommend any one HV.
Hostpolice learn from your previous expreince. you went to burst they are cheaper, have a raid and backup this time.
Try some good data center. the planet, Soft layer.
I found the planet really good.
