Spammer wants his money back

Hi there,
Recently I had 2 clients (Drew Bailey and Tyler Carson).
I suspect that it is the same person using different names.
He has been using the accounts for spamming which is against our TOS.
Thus I suspended the accounts in question.
No he claims to PayPal that the payments have been made without his
awareness so as to take his money back.
This is not possible as in case of violation the 30 Days Money Back Guarantee
isn't valid.
What am I supposed to do now?
Did anyone have any similar case(s)?
Please I need your help.

was the domain "nfscorp.org" by chance?

I had the same issue about a month ago, suspended them, but they paid with a Credit Card so they got their money back.....
 
I had this issue once .. A spammer on a vps-- they used paypal to try and get their money back.

Well I showed them proof that they were spamming on the account and that suspending the account was against the TOS.

Paypal sided with us and no refund was given.

Are you sure the cc information given for payment was theirs? That would be the question.

No the domains were:

  • wrabits.com which isn't a registered domain. Check it here.
  • tyler.com which is registered under the name Brian Cullins. Check it here.
  • drewb.com which is registered under the name Andrew Bertola. Check it here.

I've sent a mail to the support department of PayPal and I'm waiting their
response.
Let's see what follows.

Tyler signed up with us as well. We suspended him immediately after we spotted a seed.php and seed2.php file (which is used to send spam) as well as a .doc file promoting drugs.

Drew name is very familiar....

Another fraud case would be Christopher Allen with the domain name spana.com, which may not be owned by him.
I believe this would be a stolen PayPal account case.
 
Do they live in the US? If so, take legal action against those people. Charge them for every single spam email they sent (If you have a clause in your TOS for that), add collection fees, administration fees, and any other fee you can find that they agreed to so you can get as high as possible and possibly take them on legally.
 
Post your logs of the spam in the dispute console.
Post the section of the TOS in the dispute console.

paypal wont give his money back if you can prove he or someone onhis account broke the TOS.
 
This is how you know its summer time! Kids are out. However, taking legal actions will really make them think twice next time ;)

I agree with Eclouds. Go kick some butt.

Like others have said!

Show your terms of service, which says your prohibit spamming and show logs of him spamming from your server and most importantly show his IP address accociated with the account along with anything you want to pile along with that. - Heck even show them the code he used to spam. Just be honest and tell them the situation you are in and tell them what he purchased online.

You might even want to submit his wrong doings to the FBI:

I'm sure they'll give him a splash of cold water!

Just provide your evidence to paypal, and prove that the fault was theirs. I wouldn't sue them because that costs too much money. Yes, you have a very high chance of winning, but do you have the time? And you'll probably end up losing money in the end (due to fees).

Paypal will always side with you, it's virtual goods they don't refund for that.

Second, I didn't take the time to read your TOS, but based on the fact that you got worried and posted here, I'd say it's not enough. You need a clear and definitive spam clause that outlines the action you'll take.

:eek3: Spamming has nothing to do with kids. Leave them alone and stop talking rubbish.
