Terms of Service, Really need advice

We do NOT Allow child pornography in our Terms of Service, but content perceived to be child pornography AkA Lolita is not mentioned. Lolita is child modeling in clothes, sometimes skimpy and in underwear and swimsuits but can be gross when you see their naked bum underneath a low dress, etc. Lolita is legal in the United States, but child pornography is not and is Immoral. What do you all think? Im lost.. I really dont want someone ordering a package thinking they can host this stuff, which they have done in the past and for me to tell them they can not, it could leave me open to lawsuits etc.

Surely you have another clause in your TOS that allows you to disallow any content you feel is inappropriate? If so, that applies here.
 
Well then, just add a clause that disallows these types of sites, and you should be Ok. :)

LOL, that was straight to the point. All right sounds good :D. BTW we dont offer refunds unless its the day after the next bill is due ;).

I think it only used to be legal
The new law stats that anyone under 18 that looks like they could be in sexy cloths or is precived as in a sexual pose is illegal, they fixed that up to include it as child porn in the US about a year ago lol its other countys where its legal

Re-read the USC thinggy, Im sure its in there.
 
Well, that definitely sounds like it should be illegal. But if it isn't, and if there is nothing in the TOS about this, you should give them a refund.

Non sexually-explicit images of children shouldn't offend anyone (even "nudeity" - after all everyone has seen a child naked). If you feel the images are "sexually explicit", then I would suggest you forcefully remove the content. By sexually explicit I mean they're posed in some "sexually arousing" way.
 
Catlin, being a grey area means you can 'decide' whether it is content you allow or not.

My advice, delete the account (take a full account, including email & stats/logs, backup) and inform the client of such, to safeguard yourself report the content and provide a full account backup to the authorities in your area for their decision.

Yeah, that is also relating to the (I think it's called this:) One World? Or something like that, where pedophiles where creating child users in sexy clothing, and having a online molestering ring, ew.

He is talking about the ---- that idiots claimed to be "child modeling" - It happend over the last 8 years or so and is starting to be delt with now and Im sure the US has laws against it.

Anyway this is no big deal, just ban it in the TOS? I dont even see the need for a thread, you just say you dont allow it...

Something like this should do:
We do not allow child porn or any other types of sexually-explicit images of children under the age of 18. If you are found to be hosting such content on our servers you will be removed without warning and a report containing a full copy of your details and website backup will be sent to your local law enforcement office as well as our own local law enforcement office.
"MyHost" will be the soul dude thinggy who decides what is a sexually-explicit image of a child or child porn.

Im not a lawyer and I forget the word you use in replace of dude thinggy :D

I can't seem to access your site/terms of service, it says you have been suspended by freeresellers.com. As for the lolita issue, I remember a vBulletin license was revoked as there was this forum (Powered by vB) which essentially was a forum dedicated to lolita and the guys at vB said they didn't want to be accociated with such a forum...or something. - But it was quite a big issue at the time.
 
I had to suspend the box which automatically puts that page up. DDOS Attack and possible brute force and I got 20GB Worth of Files highly classified and they could get hacked so I axed it all the way to the root until I can retrieve them than I'll put it up. MyG Techs are working around the clock to fix the slight problem..
